General Terms and Conditions

1. scope of application
These General Terms and Conditions (GTC) apply to all deliveries by August Schwer e.K. (hereinafter: August Schwer) to consumers (§ 13 BGB).

5 Prices, shipping costs and customs duties

5.2 In addition to the prices quoted, we charge for delivery within
Germany a flat rate of EUR 5.50 per order.
This does not apply to small items that can be safely sent as a maxi letter in terms of size and weight. We can also send such items as maxi letters on request. In this case, the shipping costs are calculated according to weight and displayed directly in the order process.
The shipping costs for deliveries abroad and express shipments are calculated according to weight. They are calculated and displayed in the shopping cart and during the ordering process.

5.3 In the customs forms for parcels to countries outside the EU, the value of the items contained in the delivery is listed by product type. We reserve the right to provide customs with such information in order to simplify the procedure for our customers or due to legal obligations. Customs can open parcels for inspection, we have no influence on this. If the order is a gift, the parcel will be marked as a gift, but the prices of the items will still be shown on the customs form. We are currently unable to describe the content in any other way. Customs or import duties will be charged once the parcel has reached your country. Customs clearance fees are at your expense; we have no influence on these fees and cannot predict their amount. Customs regulations vary considerably from country to country. If you would like more information about this, please contact your local customs office. Please note that as an importer you must comply with the respective national regulations.

6. delivery
Delivery is made worldwide with the logistics service provider you selected in the shopping cart.

7. payment
7.1 Payment can be made in advance, cash on delivery (Germany only), by credit card or direct debit.

7.2 If you select the payment method prepayment, we will provide you with our bank details in the
order confirmation and deliver the goods after receipt of payment.

7.3 If the cash on delivery payment method is selected, we will send the goods by means of a DHL cash on delivery parcel. The amount will be collected by DHL upon delivery. Additional fees apply. This is due to the higher shipping costs charged by DHL and the transaction costs charged by DHL. Please refer to the shipping costs overview for details.

7.3 If you select the direct debit payment method, your account will be debited upon acceptance of the order. The goods will be dispatched as soon as we receive the value date from the bank.

7.4 If you select the credit card payment method, your credit card will be charged upon acceptance of the order. The goods are dispatched immediately subject to availability.

7.5 You shall only have a right of set-off if your counterclaims have been legally established by a court of law or are undisputed or have been recognized by us in writing.

7.6 You may only exercise a right of retention insofar as the claims result from the same contractual relationship.

8. reservation of title
The goods remain our property until payment has been made in full.

9. warranty
The warranty is provided in accordance with the statutory provisions. For all during

You can remove the products from the shopping cart at any time by setting the quantity field to 0 and clicking the Apply button. If you want to buy the products in the shopping cart, click on the Secure order link. Please enter your details on the following page. The mandatory information is marked with an *. Registration is not required. Your data is transmitted in encrypted form. After entering your data, please check your entries again. You complete the order process by clicking the Submit order button.
If you are paying by credit card, a page will then open where you can enter your credit card number and expiry date. The process can be canceled at any time by closing the browser window. On the individual pages you will find further information, e.g. on correction options.

Contract text
The text of the contract is stored on our internal systems. You can view the General Terms and Conditions at any time on this page. The order data and the general terms and conditions will be sent to you by email. For security reasons, this contract text is no longer accessible via the Internet once the order has been completed.

Data protection
We use the data you provide to fulfill and process your order. Your data will be passed on to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of the goods (name, address, possibly telephone number to coordinate delivery dates). In order to process payments, we may pass on your payment details to our house bank. Your credit card details will be forwarded directly to the credit card companies Mastercard, Visa and American Express for verification and authorization. We do not store any credit card data. For Mastercard and Visa, we use the Secured by Mastercard and MasterSecureCode security system, which offers you the greatest possible security.
Your data will not be passed on to other third parties. Once the contract has been fully processed and the purchase price has been paid in full, your data will be blocked for further use and deleted after expiry of the tax and commercial law regulations.
